I wrote this on my FB page on January 20th:
On the first day, the first hour, the first minute of Trump’s Presidency he will be in VIOLATION of our Constitution.
It is patently UNTRUE that the President cannot have conflicts of interest.
Forget about the emoluments clause that applies to Senators and Representatives in the Constitution — there’s another clause in Article One, Section 6, and here it is:
“No Title of Nobility shall be granted by the United States: And no Person holding any Office of Profit or Trust under them, shall, without the Consent of the Congress, accept of any present, Emolument, Office, or Title, of any kind whatever, from any King, Prince, or foreign State.”
Trump’s enterprises are sucking in foreign cash and benefits on a daily basis. The standing doctrine requires someone to be “injured” and such people and entities have standing to go to the courts, the guardians of our Constitution, for satisfaction. If he doesn’t divest, hundreds of lawsuits can and probably will be filed.
To illustrate, competitors of his hotel on Pennsylvania Avenue (which is also sucking in business from foreign dignitaries) will go to court to demand satisfaction.
Can we impeach him on Monday?
